Clear terms for websites, filming and tribute films

These Terms and Conditions apply to services provided by Memorial Web Design, operated by Luke Sutton. Services may include memorial website design, memorial video editing, original filming and combined tribute packages.

By approving a quotation, paying a deposit or asking work to begin, you agree to these terms. Nothing in these terms affects your statutory rights as a consumer.

1. Memorial Website Design & Memorial Video Production

Memorial Web Design provides personal, creative services for families and individuals wishing to remember and celebrate someone important to them.

Each project is created with care and will be based on the scope, content and requirements agreed before work begins.

2. Quotations & Project Scope

Before a project begins, you will receive a quotation or written outline describing the work included and the agreed price.

The quotation will be based on the information available at that time. Requests that materially change the agreed scope may require a revised quotation or an additional charge. Any additional cost will be discussed with you before that work is carried out.

3. Payments

Unless agreed otherwise in writing, a 50% advance payment is required before work begins. The remaining balance is payable when the project is complete and before the finished website, final video files or other deliverables are released.

Work may be paused if an agreed payment becomes overdue.

4. Timescales

Estimated timescales will be discussed before the project begins. These are estimates rather than guaranteed completion dates unless a fixed deadline has been expressly agreed in writing.

Completion depends on the timely supply of photographs, footage, wording, approvals and feedback. Delays in receiving these items may affect the delivery date.

5. Client Material

You are responsible for supplying the photographs, video, audio, wording, names, dates and other material needed for the project in a suitable format and at an appropriate quality.

By supplying material, you confirm that you have permission to use it and to ask Memorial Web Design to include it in the project. Please do not send original or irreplaceable physical items unless this has been agreed in advance.

6. Accuracy

You are responsible for checking names, dates, quotations, captions and other factual details. Drafts or previews will be supplied where appropriate so that you can review the work before final approval.

Memorial Web Design will correct mistakes introduced during production. Changes requested after final approval may be chargeable.

7. Memorial Video Production

Video projects include the editing and creative work described in the agreed quotation. Unless stated otherwise, up to two reasonable rounds of amendments are included.

A round of amendments means one collected set of feedback. Further revisions, a change of direction or replacement material supplied after editing has begun may be charged separately.

8. Original Filming

Where original filming is included, the quotation will describe the planned location, duration and coverage. You are responsible for securing access to the location and permission from the venue and people being filmed where required.

Filming may need to be adapted, postponed or cancelled where circumstances make it unsafe or impractical, including severe weather, venue restrictions, illness or equipment failure. If this happens, the options available will be discussed with you as soon as reasonably possible.

9. Music & Copyright

Music and other third-party material can only be used where suitable permission or licensing is available. Where appropriate, licensed production music may be sourced through services such as Epidemic Sound.

Music requested for private family use may still be subject to copyright restrictions or automated claims if a video is uploaded to YouTube, Facebook or another public platform. Memorial Web Design cannot guarantee that a platform will accept or continue to host third-party music.

10. Memorial Websites

The quotation will explain what is included in the design and initial setup of a memorial website. Hosting is currently approximately £12 per month unless an alternative arrangement is agreed.

Additional design, content entry or development requested after the agreed project is complete may be charged at £45 per hour. You will be told before chargeable additional work begins.

Domain names, third-party subscriptions and other ongoing services may be charged separately where applicable. These services can be affected by suppliers outside the control of Memorial Web Design.

11. Delivery & Sharing

Completed videos will normally be supplied digitally in the format agreed for the project. Memorial websites will be made available at the agreed web address once final approval and payment have been received.

You are responsible for downloading and safely keeping copies of delivered files. Please discuss any special delivery, privacy or sharing requirements before the project is completed.

12. Ownership

You retain ownership of the photographs, footage and other original material you supply. Memorial Web Design retains copyright in its original design, filming, editing and creative work.

Once full payment has been received, you are granted permission to use the completed deliverables for the personal or other agreed purposes described in the quotation. Source files, editable project files, templates and unused material are not included unless expressly agreed in writing.

13. Portfolio Use

Because memorial projects are personal, your website, video, photographs or story will not be used in a public portfolio without your permission.

If permission is given, you may withdraw it for future promotional use by contacting Memorial Web Design. This may not remove material already printed or published by an unrelated third party.

14. Cancellation

If you need to cancel a project, please give written notice as soon as possible. You will be charged for work already completed and for any non-refundable costs committed on your behalf.

The advance payment may be retained to cover this work and these costs. Any further amount due, or any refund available, will be calculated fairly according to the work completed at the date of cancellation.

15. Liability

Memorial Web Design will provide its services with reasonable care and skill. It is not responsible for delays, interruptions, data loss or service failures caused by circumstances or third-party providers outside its reasonable control.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

16. Governing Law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any rights you have as a consumer to bring proceedings elsewhere in the United Kingdom.
