These Terms & Conditions outline the services provided by Memorial Web Design and the responsibilities of both the client and service provider.
Terms & Conditions
These Terms & Conditions set out the basis on which Memorial Web Design provides memorial website design, hosting and related services. By commissioning a website, paying a deposit, approving work, submitting content or continuing to use our services, you agree to the terms below.
1. Business Details

2. Services Provided
Memorial Web Design creates memorial, tribute and remembrance websites for individuals, families, organisations and communities. These websites may include written content, photographs, tribute sections, contact forms, visitor messages, remembrance pages and other agreed website features.
The exact scope of each website will depend on what has been agreed before work begins. Any additional work requested outside the original agreement may be quoted and charged separately.
3. Deposits & Payments
A 50% deposit is required before any website design or development work begins. This deposit secures the project and allows work to commence.
The remaining balance is due when the website is ready to launch. The website will not be launched, transferred or made fully live until the final payment has been received, unless otherwise agreed in writing.
Hosting payments are separate from the website design cost and become payable from the point the website build begins, as the website requires hosting in order to operate.
4. Hosting
All memorial websites require hosting in order to remain online. Hosting is typically charged at around £12.00 per month, unless otherwise agreed.
Hosting is paid via a monthly subscription using a Stripe payment link. Stripe securely stores and processes payment details. Memorial Web Design and Luke Sutton do not store your card details directly.
Hosting includes website hosting and snapshot backups. These backups are intended as a safety measure in the event of technical issues, but they should not be treated as a full website maintenance, archive or content management service.
If hosting payments are cancelled, missed or unpaid, the website may be suspended, taken offline or removed after reasonable notice has been given.
5. Maintenance & Website Changes
Website maintenance is not included within the monthly hosting fee.
Any requested changes, updates, amendments, new pages, content uploads, design changes or technical work after launch may be charged at an hourly rate of £45.00 per hour.
Small changes that only take a few minutes may occasionally be completed free of charge at the discretion of Memorial Web Design, but this is not guaranteed and does not form part of the hosting agreement.
6. Timescales
Memorial Web Design aims to complete most memorial websites within approximately 7 days of the deposit being paid and the required content being provided.
Typical lead times are between 5 and 14 days, depending on workload, the size of the website, the complexity of the project, the speed of communication and how quickly the client provides the required text, images and information.
Timescales are estimates only and are not guaranteed. Delays may occur if content is not provided, feedback is delayed, additional features are requested, or circumstances arise outside our reasonable control.
7. Client Responsibilities
The client is responsible for providing all required website content, including text, photographs, names, dates, tribute wording, biographies, funeral information, charity details and any other material required for the website.
The client is responsible for checking all content before and after publication, including spelling, dates, names, facts, images, links and any tribute submissions approved for publication.
The client must ensure that they have the legal right to use any text, photographs, logos, videos, music, documents or other content supplied for use on the website.
8. Copyright & Uploaded Content
The client remains fully responsible and liable for any content they supply, upload, approve or allow to be published on the website.
This includes, but is not limited to, photographs, written tributes, biographies, poems, quotes, images, documents, video, audio, logos and any visitor-submitted content.
Memorial Web Design and Luke Sutton are not responsible or liable for copyright infringement, image misuse, unauthorised content, offensive content, disputed content or any legal claims arising from material supplied, uploaded, approved or published by the client or website users.
If a third party raises a copyright, privacy or content complaint, the client is responsible for dealing with that matter.
9. Tributes, Comments & Visitor Submissions
Some memorial websites may allow visitors to submit tributes, memories, comments, photographs or other content.
The client is responsible for deciding what content is allowed, approved, published or removed from the website.
Memorial Web Design and Luke Sutton are not responsible for any offence, distress, disagreement, copyright issue, privacy issue, family dispute, defamatory statement or other issue caused by visitor-submitted content that the client allows, approves or publishes.
10. Offensive, Sensitive Or Disputed Content
Memorial websites can sometimes involve sensitive family matters, personal history, religious views, public reputation, private relationships or disputed accounts of events.
The client is fully responsible for ensuring that any content published on the website is appropriate, accurate and lawful.
Memorial Web Design and Luke Sutton are not liable for offending any person, organisation, family member, friend, visitor or third party as a result of content supplied, approved or published by the client.
11. Ownership & Use Of Website Design
The finished website is provided for the client’s use as a memorial or tribute website once all agreed payments have been made.
However, the website design, layout, structure, code, styling, build process and overall website framework remain the intellectual work of Memorial Web Design and Luke Sutton unless otherwise agreed in writing.
The client must not copy, reproduce, resell, rebrand, claim authorship of, duplicate or pass the website design to another designer, developer, agency or business for them to present as their own work.
Although websites created by Memorial Web Design may not always be visibly branded, they must not be stolen, copied, reproduced or rebranded under another entity.
12. Third-Party Tools & Services
Memorial websites may use third-party tools, plugins or services to function correctly. These may include WordPress, Google Analytics, Yoast SEO, payment processors, security plugins and hosting systems.
Memorial Web Design is not responsible for failures, changes, downtime, pricing changes or service interruptions caused by third-party providers.
13. Privacy & Personal Information
Memorial Web Design does not sell or knowingly disclose personal information to unrelated third parties.
Information submitted through contact forms, email enquiries or project discussions will only be used for providing services, communication and website administration.
Payment details are securely handled by Stripe. Memorial Web Design and Luke Sutton do not directly store payment card details.
14. Website Availability
Whilst every effort is made to keep websites online and functioning correctly, no guarantee can be given that a website will remain continuously available without interruption.
Downtime may occur due to maintenance, hosting issues, software updates, security concerns or circumstances beyond our reasonable control.
15. Search Engines & Website Performance
Basic SEO practices may be implemented where appropriate. However, Memorial Web Design cannot guarantee search engine rankings, website traffic, enquiries, conversions or business results.
16. Cancellation
If a project is cancelled after work has commenced, the deposit may be retained to cover time spent, planning, administration and development work already completed.
Hosting subscriptions may be cancelled at any time, however cancellation may result in the website being suspended or removed.
17. Refunds
Deposits are generally non-refundable once work has started.
Refunds are not normally available for completed work, launched websites, hosting services already provided or time already spent on the project.
18. Limitation Of Liability
Luke Sutton and Memorial Web Design shall not be liable for indirect losses, emotional distress, reputational issues, disputes, loss of data, loss of income, copyright claims, visitor-generated content or any damages arising from the operation or use of the website.
The client accepts full responsibility for all content supplied, uploaded, approved or published on the website.
19. Changes To These Terms
These Terms & Conditions may be updated from time to time. The latest version published on this website shall apply.
20. Governing Law
These Terms & Conditions are governed by the laws of England and Wales and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
